Nevada

This is general information, not legal advice. Nevada's small claims procedure is in NRS chapter 73 and is used in justice court. NRS 73.010 says an action may be brought for the recovery of money only, where the amount claimed does not exceed $10,000. The chapter then covers where the action is filed, how it is started, and how attorney fees on appeal are limited. Money only is a real limit. A request that someone return property or perform a contract is outside the sentence that creates the action. Justice courts sit in townships. The clerk of the justice court that has venue under the chapter is the clerk who takes the claim. The $10,000 figure is the amount claimed.

Chapter 73 is short. Read the section on where to file before you pick the most convenient township. The statute ties filing to the justice court designated in that chapter, often connected to where the defendant lives or where the obligation was to be performed. A claim that does not exceed $10,000 can still be filed in the wrong township. Service follows the method the chapter and the justice-court rules require. Bring a calculation that stops at $10,000. If you are owed more, filing here means you are claiming only what the statute allows in this action.

Attorney fees are addressed narrowly in the chapter. One provision limits an attorney fee the district court may award in a described appeal situation to a sum not to exceed $15. That figure is an attorney-fee cap on appeal in the statute's words, not the filing fee and not the jurisdictional amount. Do not confuse the two. The $10,000 line is the claim. The $15 line is a fee the statute mentions for a lawyer in that appeal setting. Most people appear without a lawyer. You may read the chapter yourself. The justice court judge hears the evidence and decides the money.

A judgment for money still has to be collected. Justice courts issue the writs their statutes allow. Ask the clerk after the judgment, and after any appeal time, which form to use. This directory does not state a filing fee. Township courts can publish local fee lists. If the claim exceeds $10,000, or if you need relief other than money, file in the court that has jurisdiction of that kind of case. District court is the general trial court. Justice court small claims is the money docket chapter 73 describes. Use the official NRS page, because commercial summaries of Nevada's limit have been wrong in both directions over the years.
