Wyoming

This is general information, not legal advice. Wyoming's small claims procedure is Article 2 of Title 1, chapter 21, and it is used in circuit court. Section 1-21-201 says that in civil cases before a circuit court in which the amount claimed, exclusive of costs, does not exceed $6,000, the procedure is the one defined in sections 1-21-201 through 1-21-205. The remedy is cumulative, not exclusive, so a person may choose another procedure the law allows. The state, a governmental entity, a person, a corporation, a partnership, an association, or another organization may start a case by affidavit. The affidavit must give the defendant's address, the nature of the claim, the amount due, and a statement that demand was made and payment was refused. Costs are outside the $6,000.

Demand before filing is a statutory requirement, not a courtesy. Section 1-21-202 says the affidavit states that demand has been made and payment refused. Make the demand, keep a copy, and be ready to say when it was refused. The same section says parties may litigate in person or through authorized employees, with or without an attorney. If an attorney appears, the opposing party is entitled to a continuance to get an attorney. That continuance is automatic in the statute's words once a lawyer appears for the other side. Circuit judges docket the case. Venue follows the venue statutes the article incorporates, including W.S. 1-5-104(b) and 1-5-105 through 1-5-109.

Service may be by the usual legal method or, if the defendant lives in Wyoming, by certified mail to an in-state address with return receipt requested. Service by mail is complete when the circuit judge receives the receipt signed by the defendant or the defendant's agent. The appearance date must be not more than 20 days and not less than 12 days from service. Those day counts are in section 1-21-204. Put them on the summons the way the statute requires. A $6,000 claim that is served too late for that window has to be reset.

Because the remedy is cumulative, a claim of $6,000 or less might also be filed under ordinary circuit-court procedure. Small claims are the affidavit path. Ordinary procedure is available if you want it. A claim above $6,000, exclusive of costs, is not this article. Circuit court also has broader civil jurisdiction. After a judgment, ask the clerk about execution.
